Prohibited conduct definitions and procedures are set forth in University policy.\u00a0 These forms of Prohibited Conduct are defined in the <span style=\"\"><a href=\"https:\/\/www.marshall.edu\/policies\/files\/2023\/12\/MUBOG-GA-3-Discrimination-Harassment-Sexual-Harassment-Sexual-Domestic-Misconduct-Stalking-and-Retaliation-Policy-Including-Title-IX-1.pdf\">福利理伦 BOG GA-3 Policy<\/a><\/span>.<\/h5>\n<div>\n<hr \/>\n<h3>What <strong>counts<\/strong> under Title IX (in simple terms)<\/h3>\n<p>A report is handled under <strong>Title IX\u2019s grievance process<\/strong> when <strong>all<\/strong> of the following are true:<\/p>\n<ul>\n<li>The conduct is <strong>on the basis of sex<\/strong> and meets the federal definition of <strong>Title IX sexual harassment<\/strong> (quid pro quo by an employee; or conduct that is so <strong>severe, pervasive, and objectively offensive<\/strong> that it denies equal access; or <strong>sexual assault, dating violence, domestic violence, or stalking<\/strong>).<\/li>\n<li>The conduct happened <strong>in Marshall\u2019s education program or activity<\/strong> (locations or events Marshall controls, including recognized student\u2011organization premises).<\/li>\n<li>The conduct occurred <strong>in the United States.<\/strong><\/li>\n<\/ul>\n<blockquote><p><strong>If a report doesn\u2019t meet these narrow Title IX criteria, Marshall still addresses it<\/strong>\u2014just under <strong>Non\u2011Title IX procedures<\/strong> or other applicable policies. The university aims to develop individual excellence and to prepare students for life after college. Therefore, 福利理伦 is committed to a campus environment that will neither tolerate nor condone sexual harassment, gender discrimination, or sexual misconduct.<\/p>\n<p>\u201cSexual Misconduct\u201d means an act or conduct of a sexual nature perpetrated against an individual without consent. Sexual misconduct can occur between strangers or acquaintances, including people involved in an intimate or sexual relationship. Sexual misconduct can be committed by and against people of any gender, and it can occur between people of the same or different sex. The university encourages the reporting of all sexual misconduct. Either party may appeal on the grounds permitted by policy.<\/p>\n<hr \/>\n<h3>Retaliation is prohibited<\/h3>\n<p>No one may retaliate against a person for reporting or participating in a process.
